  • These visas are normally for applicants who are in same sex relationships.
     
  • Main applicant must be in a mutually exclusive and enduring relationship with an Australian citizen, permanent resident or eligible New Zealand citizen.
  • Main applicant must be sponsored by their Australian citizen, permanent resident or eligible New Zealand citizen partner.
  • Main applicant must be able to demonstrate that they have been cohabiting with their sponsor for a minimum period of 12 months or that if they have lived separate and apart it has been for reasons beyond 42-16731836their control.
  • Main applicant must be able to provide a minimum of 12 months documentary proof that the relationship is mutually exclusive and enduring.
  • Sponsor must be able to demonstrate that they are financially capable of meeting the applicant's needs during the initial period of residence.
  • The subclass 310/826 visas are 2 stage visas that provide the holder with a 2 year period of residence in Australia while the permanent visa is decided.  The holder has full employment rights and access to the Medicare health scheme.
  • The subclass 110/814 visas grant permanent residence to the holder from initial visa grant.   These visas are either granted as the second stage visa for the holder of the 310/826 visas or to applicants who are able to demonstrate that they have been in a relationship with their sponsor for a minimum of 5 years as at time of initial application.
  • Main applicant may include children from other relationships as secondary applicants on the main application.
  • All applicants will have to meet health requirements.
  • All applicants 16 years and older will have to meet character requirements.
  • Subclass 310/826 visas are valid for 24 months and allow multiple entries into and out of Australia during this period.
  • Subclass 110/814 visas are valid for 5 years and allow multiple entries into and out of Australia during this period.
